The court order, which also lifted a stay on an October ruling by the Ingham County Circuit Court, means that MSU should have to disclose the names of suspects who were among the 301 student-athletes that ESPN had identified in its original request under the Michigan Freedom of Information Act. ESPN had asked for the records as part of an Outside the Lines investigation that examined how various universities dealt with student athletes who were accused of crimes. Michigan State, defending its decision to redact names from the incident reports, had cited privacy exemptions in the FOIA statute. But the Ingham County Circuit Court and the Michigan Court of Appeals both ruled that the exemptions should apply only to victims and witnesses named in the reports. Disclosing the names of suspects but not victims "balanced the public's interest in understanding how the University's police department handles criminal investigations involving student-athletes against the student-athletes' privacy interests," a Court of Appeals panel ruled in August. Wednesday's Supreme Court order, though brief, indicated that justices were not convinced that the case warranted their review. Justice Stephen J. Markman published a written dissent noting that MSU was not attempting to withhold information about students who were actually prosecuted. He questioned whether the disclosure of unredacted incident reports "will serve FOIA's core purpose without infringing the privacy interests of some affected students."
